What is a Certificate of Occupancy?
A Certificate of Occupancy (CO) is a legal document that proves a structure is safe to inhabit and up to code. Requirements for a CO:
1.Inspections – An inspector will inspect the property’s interior and exterior, including electrical,HVAC, plumbing, fire safety, and mechanical systems.
2.Compliance- Verification that the property meets local, state and federal laws and regulations,including zoning, building, fire and parking codes.
3.Property details- The property’s address, owner, and legal use, such as residential, commercial orindustrial.
Why do I need to get a Certificate of Occupancy? The Certificate of Occupancy (CO) is required for new construction, additions, or when a change of use occurs. Lenders often require a CO to be completed before final underwriting for new construction. Banks, financial institutions and government agencies may also require a copy of the CO as institutions, and government agencies may also require a copy of the CO as proof of legal occupancy. When do I need a Certificate of Occupancy? A Certificate of Occupancy (CO) is required for any building. A new (CO) is required whenever any of the following occurs:
1.Any new building or residence that is constructed and will be occupied.2.An existing building or lease space undergoes an addition of space.3.Any use of tenant or lease space is changed. (Primarily Commercial)4.Any change in the use that would place the building or lease space in a different classification. Examples: Garage changes to a living space; commercial space changes to a residence; residential change to a business; etc.
How to apply for a Certificate of Occupancy?
An applicant for a Certificate of Occupancy must be the owner of the property or the owner’s representative. An applicant should have the following information:
1.You will need to go to our website at https://www.galvestontx.gov/162/Building-Division and at the top of the page is a link for both Residential and Commercial applications.
2.Complete the application that applies to you.
3.Each application requires associated documents to be submitted.
4.All the associated documents must be submitted with the application.
5.The fee for application submittal is $50.00.
Notice: In the event a Certificate of Occupancy is not required for a change of tenant, a Certificate of Zoning Compliance may be required. Contact the Planning Division at 409-797-3660 or planning@galvestontx.gov for more information.
